Terms and conditions of use

Radio France, a national programming company with capital of 114,870,093 euros and registered with the Paris R.C.S. under no. 326 094 471, whose head office is located at 116, avenue du Président Kennedy 75220 Paris Cedex 16, operates several fixed websites and their mobile versions, as well as applications for smartphones and tablets.

The User is kindly requested to carefully read the General Terms of Use of the Sites, the page relating to data protection-privacy policy as well as the information page on cookies before consulting the Sites.

The purpose of these General Terms of Use is to define the terms of Access and use of the Sites, on any Equipment.

Consultation of the Sites is subject to full acceptance of these General Terms of Use. As such, Radio France reserves the right to modify these General Terms of Use and/or to update them, at any time. The applicable version of the General Conditions of Use is the one online when the User consults the Sites.

The User of the Sites undertakes to comply with these General Conditions of Use. Should the User fail to do so, Radio France reserves the right to take any measure necessary to protect its interests, and in particular to take legal action against said User.

When the User is a minor, he or she declares that he or she has obtained prior authorization from his or her parents or guardians, who vouch for the User's compliance with these General Terms of Use. The Use and consultation of the Contents of the Sites by the minor User are carried out under the control of his/her parents or persons holding parental authority.

Article 1: Definitions

For the purposes of these General Terms of Use, each of the terms defined below shall have the meaning of its definition:

  • "Access to the Sites": refers to any consultation, browsing, on the Sites by Users.
  • "User Account": refers to the account of each User who has previously registered, enabling him/her in particular to access personalized Content. The User Account is created by the User, following the entry of personal information enabling the User to be identified, and to memorize his/her choices. Each User Account is secured by an identifier and a password.
  • "Ticketing Account": refers to the account created by the User on the Site maisondelaradioetdelamusique.fr on which Radio France's electronic ticketing service is accessible, which allows the User to finalize the purchase of tickets or the reservation of tickets for free events. Access to the Ticketing Account is by means of a login and password kept by the User.
  • "General Conditions of Use" or "GCU": means the set composed of the present, accepted by the Users, governing Access to and use of the Sites.
  • "Content(s)": refers to any element constituting or published on the Sites, regardless of genre, such as, in particular, text, sound, music, photographs, images, logos, graphic design elements and interfaces, videos, software, databases, etc.
  • "Equipment(s)": refers to all types of terminal on which the Sites are published, including in particular computers, tablets and smartphones.
  • "Mediator Message(s)": refers to messages that Users may send to the Radio France Mediator via a dedicated form available on the Site accessible at mediateur.radiofrance.com, under the conditions defined in Article 8 hereof.
  • "Voice Message(s)" : refers to contributions or questions that Users may submit via a dedicated form available on the pages of the France Inter and France Bleu Sites and which may be broadcast in voice format on-air under the conditions defined in article 8 hereof.
  • "Player": refers to the application used to watch and/or listen to the video and audio files present on the Sites as well as to broadcast and share them outside the Sites under the conditions set out in article 7 hereof.
  • "Site(s)": refers to the Internet Sites published by Radio France including the sites radiofrance.fr, maisondelaradioetdelamusique.fr, mediateur.radiofrance.com, as well as the websites of the France Inter, France Culture, France Musique, France Bleu, Mouv', FIP channels and their mobile variations available on Equipment, including, where applicable, mobile applications.
  • "User(s)": refers to any person consulting the Sites and/or contributing to the sharing areas of the Sites, identified or not by a User Account.

Article 2: Purpose

The purpose of these General Terms of Use is to define and set the terms and conditions under which Radio France makes the Sites available to Users.

They also set the conditions under which the User accesses and consults the Sites.

These General Conditions of Use may be supplemented by special conditions specific to the services contained on the Sites, such as game rules or general conditions of sale for online ticketing, for example.

Article 3: Access to the Sites

Access to the Sites implies, on the part of Users, full knowledge and acceptance of these General Conditions of Use in their entirety.

Access to the Sites enjoyed by the User is free of charge and the Sites are accessible 24 hours a day, 7 days a week.

However, it should be specified that Radio France cannot be held liable due to technical impossibility of connection, in particular malfunctioning of the Sites or unavailability of Content, whether this is due to force majeure, a maintenance operation, an editorial update, an internal or external strike, a network failure or power cut, incorrect configuration or use of the computer by the User or any other cause dependent, or not, on its will.

Radio France cannot be held responsible in the event of contamination by a virus, or any other computer infection, of the User's Equipment. It is the User's responsibility to take all appropriate measures to protect his/her data, software and Equipment from any source of contamination.

Access to the Sites does not require prior registration. However, the creation of a User Account is required to access personalized content.
A Ticketing Account must be created to reserve seats for events organized by Radio France or to pay for tickets online, where applicable, from the www.maisondelaradioetdelamusique.fr site.

Article 4. Use of Content

Content (including archived or cached content) may not be used outside the provisions of these Terms and Conditions of Use, in particular for commercial purposes, or for the training or development of any automatic learning or artificial intelligence software or system whatsoever, without the prior written authorization of Radio France, including when the purpose pursued is non-commercial.

Unless authorized in writing and in advance by Radio France, the Content may also not be used by software and/or artificial intelligence systems to generate content in response to requests made by their users.

Any individual or legal entity failing to comply with these prohibitions may be held liable as a result.

Radio France may use any technical means to restrict access to the Content on its Sites by robots and/or any other technology reproducing and/or using its Content, in particular for the purposes of training or developing machine learning or artificial intelligence systems.

Article 5. User Account

Any User over the age of 15 is entitled to create his or her own User Account. In the event that Radio France becomes aware that a User under the age of 15 has created a User Account, Radio France reserves the right to delete said Account.

The User Account will be created simultaneously on all Radio France Sites.

The creation of a User Account allows any User to create a personal profile, the main function of which is to be offered personalized Content according to their habits but also : ;

  • Favorite programs or Content ;
  • Save Content to read later ("Read later" feature) ;
  • Create playlists of musical tracks and export them to third-party platforms such as Spotify, Deezer or Apple Music ;
  • Manage newsletter subscriptions ; ;
  • Modify User Account settings and preferences.

To obtain a User Account, but also to connect to it, the User must click on the "Connect" link on the Sites or "My account" in the Radio France application settings, depending on the pages visited by the User, and then follow the instructions given. He/she must then fill in the following mandatory information:

  • Email address (which will be used in particular as a login for access to the Platform)
  • Password.

The User undertakes to provide accurate data. Users must keep their authentication details confidential. Therefore, he/she shall refrain from communicating these elements to others.

In order to enable the creation of his/her User Account, the User must tick the box materializing his/her express and personal acceptance, without restriction or reservation, of the entirety of the present GCU attesting to the fact that he/she has read them.

The creation of the User Account will only be effective once the User has ticked the aforementioned box and received from Radio France a nominative User Account activation confirmation email sent by Radio France to his/her attention.

It is specified that the User may at any time request the closure of his/her User Account and the deletion of his/her User Account data directly within the User Account settings.

The User is informed of the fact that when he has connected to the Sites via his User Account, he will be automatically connected during his next visits, unless he takes the step of disconnecting at any time.

The User is informed of the fact that he may receive emails concerning the activity and operation of his User Account.

Article 6: Intellectual property

Respect for rights: All Content present on the Sites is protected by French and international legislation on intellectual property law and/or press law, as well as personality rights (image rights). Consequently, the User of the Sites undertakes that none of this Content may be reproduced, modified, rebroadcast, translated, exploited or reused for promotional or commercial purposes in any way whatsoever without the prior written consent of Radio France and/or the relevant rights holders, including for the purposes of training and/or developing any software and/or machine learning or artificial intelligence systems, as well as for any use by such systems to generate Content in accordance with requests made by their users.

6.1 Ownership of rights

All Content is protected by French and international legislation on intellectual property rights (article L.122-4 of the Intellectual Property Code in particular), press law and personality rights (image rights).

Under these rules, any reproduction (including by downloading, printing etc.), representation, adaptation, translation, transformation and/or transfer to a third-party website, of all or part of the aforementioned Content is prohibited without the prior written authorization of Radio France and/or the holder of the rights.

In the same way, any reproduction, representation, modification, use, exploitation and/or transfer of all or part of the Contents in particular for the purposes of training and/or development of any software and/or machine learning or artificial intelligence system, , as well as for any use by these systems with a view to generating Content in the context of requests made by their users, is prohibited without the prior written authorization of Radio France.

Radio France grants the User, insofar as it is concerned and subject to the rights of third parties, a free, non-exclusive right of access for individual consultation or within the strict framework of his/her family circle to all the Sites. This right of access enables the User to consult the Sites, to use the Contents and to contribute to the Participative Spaces in full compliance with these General Conditions of Use.

It is specified that the General Conditions of Use do not entail the transfer of any rights including intellectual property rights to the benefit of the User.

Unauthorized use of the Content may give rise to civil and/or criminal legal proceedings (in particular under the offence of counterfeiting) and, where applicable, the payment of fines and/or damages.

6.2 Trademarks and logos

The trademarks of Radio France and its partners, including the corresponding logos appearing on the Sites, are registered trademarks, protected as such by French and international legislation on intellectual property rights (article L.713-2 of the French Intellectual Property Code). Without the prior written authorization of their owners, any use of these trademarks or logos is prohibited.

Unauthorized use of a protected trademark or logo may give rise to civil and/or criminal legal proceedings (notably under the offence of counterfeiting) and, where applicable, the payment of fines and/or damages.

6.3 Hypertext links pointing to the Sites

By creating one or more hypertext links pointing to the Sites, the User undertakes not to make any modifications to the Content (eg.

The publication on third-party websites of hypertext links pointing to the Sites is prohibited when said third-party websites disseminate illegal information and/or content (such as apology for crimes against humanity, child pornography, incitement to racial hatred, etc.) or are likely to harm the image and respectability of Radio France, its channels and its employees. The same applies to any hypertext link reproduced on websites containing elements likely to incite hatred or violence or to undermine the dignity of a person or group of people on the grounds of their gender, sexual orientation or disability.

In any event, it is the User's responsibility to obtain from rights holders (e.g.: societies for the collective management of copyrights and neighboring rights), any authorizations necessary for the communication of Content to the public and, where applicable, to pay any related remuneration.

Whatever the type of hypertext link pointing to the Sites, the User is not authorized to set up a systematic referencing mechanism for all or part of the Content (radio broadcasts, videos...) making it possible to offer on a service, application or Internet site other than those of Radio France, the referencing of said Content to the public, for commercial purposes in particular, without the prior written authorization of Radio France.

Finally, the hypertext link must not, in any way, enable the setting up of a system facilitating the mass sending of messages, such as a pre-written message addressed to an e-mail address linked to the Sites.

6.4 Hypertext links reproduced on the Sites

The Sites may contain hypertext links pointing to third-party websites or services. Radio France makes its best efforts to provide the User only with links to third-party websites or services that are free of anomalies, but cannot guarantee their quality or reliability.

The User is solely responsible for consulting these third-party websites or services. Consequently, Radio France may not be held liable for any direct or indirect damage suffered as a result of consulting a website or third-party service pointed to from a page on one of the Sites.

Article 7: Use of the Player

The Player, as made available by Radio France, allows video and audio files to be viewed and listened to as well as broadcast. Under no circumstances does Radio France authorize the downloading and saving of said files, unless expressly authorized by Radio France in writing.

The Player present on the Sites is the exclusive property of Radio France. The User therefore undertakes to use the Player solely for strictly personal and private use.

The Player is protected by copyright and, as such, must only be used as it is made available by Radio France.

Radio France prohibits any use that the User makes of the Player that would be contrary to these General Terms of Use and more generally to legislative and regulatory provisions in force, and in particular:

  • Any commercial use made of all or part of any of the elements of the Player;
  • Any modification, copying, adaptation, representation, reproduction, alteration, deletion, decompilation, transfer of any of the components of the Player, its functionalities or its presentation;
  • Any modification, adaptation and/or alteration of all or part of any of the Content of the Player;
  • Any blocking, masking and/or deletion of all or part of the functionalities of the Player ;
  • Any reproduction, representation or copying of all or part of the Player's Content;
  • Any representation, broadcasting, reproduction, making available to the public of all or part of any of the Player's elements enabling the normal use of the Player to be circumvented;
  • Any broadcasting of the Content broadcast on the Player of video and audio files outside the Radio France Sites.

Article 8: Participatory spaces

Radio France allows Users to contact the Médiatrice des antennes de Radio France, via its Site available at the following address: https://mediateur.radiofrance.com, by completing a dedicated form.

In this context, the User undertakes to provide correct contact details revealing a true identity, allowing third-party services to contact him/her, if necessary.

The User is expressly informed that the Mediator Messages he/she publishes on the Site may be made visible and are therefore accessible to all Users.

The France Bleu and France Inter pages offer Users the opportunity to participate in interactive broadcasts by submitting voice messages, written messages, videos or even photos via the Messenger and WhatsApp applications, both belonging to the Meta group. To do so, the User completes a form dedicated to this purpose, and accepts the attached legal notices. He acknowledges that he is expressly informed that his Voice Messages, written messages, photos or videos may be broadcast as they stand on air, or taken up or summarized in the voice of the on-air host.

The User is informed that the use of these messaging platforms is subject to the General Terms of Use of the Meta company (Facebook Messenger, WhatsApp).

The User acknowledges that he is solely responsible for the Mediator Messages and Voice Messages, written messages, photos and videos that he submits. As such, Radio France shall not be held liable in the event of any claim or recourse that may be made against it on the basis of a Mediator Message published on the Site or a Voice, Written, Photo or Video Message broadcast on air.

The User warrants to Radio France that he/she has the necessary rights to publish his/her Mediator Messages and to broadcast his/her voice, written, photo or video Messages, in particular copyright, rights related to copyright, trademark rights as well as personality rights (right of publicity) that may apply, and that these Mediator Messages and voice, written, photo or video Messages are not illicit with regard to the laws and regulations in force, and in particular press law and public decency.

Subject to the rights of third parties, the User grants Radio France, free of charge and non-exclusively, the right to use (including the rights to reproduce, represent, modify, distribute, adapt, etc..) and/or to broadcast, in particular on Radio France's stations, all or part of the Mediator Messages and/or voice or written messages, photos or videos for the entire duration of the intellectual property and for the entire world.

The User undertakes to send only Mediator Messages and/or voice or written messages, photos or videos that comply with French legislation and regulations. As such, freedom of expression must not undermine respect for the person of others and human dignity or public order and morality. Thus, the User is forbidden in particular from

  • Sending on the Sites Mediator Messages and/or Voice Messages, writings, photos or videos of an advertising or promotional nature;
  • Sending on the Sites Mediator Messages and/or Voice Messages, writings, photos or videos emanating from trade union or political organizations;
  • Send on the Sites Mediator Messages and/or Voicemail Messages, writings, photos or videos contrary to public order and/or morality, discriminating, violent, racist, sexist, anti-Semitic, xenophobic, revisionist, glorifying war crimes, abusive or rude, hateful, obscene, pornographic, pedophilic, likely to offend the dignity of the human person, etc..
  • Sending on the Sites Mediator Messages and/or Voice Messages, writings, photos or videos containing false information, confidential information, information unrelated to the theme, messages constituting denigration and/or messages characterizing harassment, defamation, insults, speculations;
  • Sending on the Sites Mediator Messages and/or Voice Messages, writings, photos or videos inviting to commit illicit or dangerous acts (crimes, misdemeanors, consumption of prohibited substances, etc.) and those inciting to piracy.) and those inciting computer piracy;
  • Send on the Sites Mediator Messages and/or Voice Messages, writings, photos or videos contrary to copyright or neighboring rights, to the law applicable to databases, to trademark law, to image rights, to the right to privacy or which would infringe any other legislative or regulatory provision in force;
  • Generate a server overload, in particular by using the Sites to send unsolicited advertising;
  • Use any hardware or software likely to alter, hinder or distort the operation of Radio France's services and Sites, or introduce any data into a Radio France automated data processing system likely to alter, hinder or distort the normal operation of Radio France's services and Sites, and in particular to circumvent the restrictions on use defined by these General Terms of Use ;
  • Send Mediator Messages and/or Voice Messages, writings, photos or videos on the Sites that infringe the image and/or trademarks of Radio France.

In the event of non-compliance with this article, Radio France reserves the right, without prior notice to the User, to delete his/her User Account if he/she has one.

In addition, by virtue of current French legislation and related case law, Radio France reserves the right to implement, at its discretion, moderation procedures and/or measures on the Sites.

Article 9: Personal data

9.1 Data collected

Personal data is information that enables the User to be directly or indirectly identified and possibly linked to the data processed. Data is collected either directly when the User freely communicates it, or indirectly when the data is, for example, collected automatically using IT means.

When data is collected directly from the User: this concerns data that the User fills in directly on the Sites depending on the nature of the service requested:

  • Subscription to newsletters;
  • Creation of the User Account and access to personalized content;
  • Online ticketing;
  • Program participation or interaction form;
  • Games competitions, etc.

For participation in competitions and subscription to newsletters from Radio France, its channels or its partners, the personal data collected on the Sites concerns the identity of the person (surname, first name, postal address, email address, date of birth, ...)
As part of the creation of a Ticketing Account the personal data collected is as follows:

  • Civil status, identity (surname, first name, postal address, email address, telephone number, ...);
  • Data relating to means of payment: credit card number, expiry date of credit card, cheque number, ...).

When creating a Ticketing Account on the www.maisondelaradioetdelamusique.fr site, the User undertakes to provide only accurate and up-to-date information, revealing a true identity that could not infringe the rights of third parties (such as, for example, trademark or intellectual property rights).

When creating and managing his account, the User may also choose to subscribe to the newsletters of the Sites and their services according to the list of choices offered. The User may also unsubscribe at any time by clicking on a link present on all emails sent as part of the newsletter and/or from the settings of his/her User account.

  • In the case of the User Account, only the email address (which will be used in particular as a login for access to the Platform) must be collected. Additional data may be requested.
  • In the case of participation or interaction in a broadcast, the User may send - via Messenger and WhatsApp - voice, written, photo or video Messages which may, at the channel's discretion, be broadcast on Radio France's stations.

Users are informed of the compulsory or optional nature of the answers they are invited to provide, as well as of the other compulsory legal notices (identity of the data controller, data recipient(s), rights they hold, etc.).

Where data is collected indirectly: this refers to data collected automatically using IT means, enabling the User to be identified indirectly. This data relates to the User's use of the Sites. It may notably concern:

  • Connection data (IP address, logs, ...);
  • Data relating to Equipment (type of Equipment, operating system, ...).

This data may be used, within the limits of applicable law, for the purposes indicated in article 9.3 hereof.

9.2 Cookies and other tracers

Cookies also make it possible to collect personal data.

The term "Cookies" refers to all tracers (pixel tag, bugs, web storage, ...) deposited and/or read during consultation of the Sites, for example. It is information deposited in the persistent memory (hard disk, for example) of the User's Equipment by the browser at the request of the Site or of a third-party script present on the Site visited. In the specific case of mobile applications, it is the application that directly controls Cookies, and can store and read information linked to current browsing in persistent memory. Under no circumstances can another application present on the User's Equipment access the stored information.

The Cookie contains several data:

  • the name of the server that deposited it;
  • a name / value pair that may or may not contain personal data (examples: "language" = "French" or "unique ID" = "123654");
  • eventually, a Cookie expiration date.

This information is sometimes stored on the Equipment in a simple text file that a server accesses to read, transmit information to the server of the page consulted and record information.

Under no circumstances can a Cookie be spyware or a virus or damage the User's system, nor can it destroy files or alter programs.

These Cookies may be Radio France Cookies, or Cookies from third-party companies whose code excerpts (scripts or development kits) Radio France integrates into its pages or applications.

Radio France uses Cookies in order to offer services and content, particularly advertising, tailored to Users' centers of interest. They also make it possible to compile visit statistics, record data communicated, share content present on the Sites via social network platforms, as well as to improve Users' browsing experience.

It is recalled that certain Cookies are necessary for browsing the Sites and for their proper functioning. They enable the User to access the main functionalities of the Sites.

It is specified that Radio France does not control the use made of Cookies deposited by third parties, for example by advertisers, or those resulting from the use of parts of the Sites hosted by a third party.

Users may at any time manage the use of Cookies by using the functions of their browser software.

9.3 Purposes of processing

Personal data communicated by Users on the Sites are subject to the French Data Protection Act no. 78-17 of January 6, 1978, as amended, as well as the European Regulation 2016/679/EU on the protection of personal data of April 27, 2016.

Personal data may be used for the following purposes:

  • Create and manage User Accounts;
  • Perform operations relating to customer management: facilitating ticket reservations on the Sites, informing of event postponements or cancellations, communicating news and information from Radio France and its channels, proposing events tailored to the User's needs, ..
  • The sending of electronic mail (newsletters, information or alerts) for the purposes of information and canvassing for the activities and events of Radio France and its channels, and possibly its partners, if the User has so wished;
  • The compilation of statistics on the frequentation of the various Contents of the Sites ;
  • Improving and, where appropriate, customizing the Sites, including in particular the provision of services and content tailored to Users of the Sites;
  • Storing in a database for internal management purposes;
  • Organizing contests;
  • Sharing the User's reactions on the social networks to which he or she is connected or sharing Content from the Sites;
  • Displaying personalized advertising.

Radio France reserves the right to undertake anonymous statistical studies and analyses on the use and typology of Users of the Sites based on personal data concerning them, on the number of pages to which Users have been exposed and clicks on the various links proposed including those triggering the playback of audio or video media.

9.4 Recipients of the personal data collected

The personal data collected is intended for Radio France and in particular for the following departments:

  • The Relationship Marketing Department;
  • The Digital Department;
  • The Music and Cultural Creation Department.

The personal data collected by Radio France for the purposes described in Article 9.3 is neither sold nor exchanged. It will not be transferred to third parties, except in the context of games where prizes may be won. In this case, Radio France may, subject to the User's agreement, communicate the winner(s)' e-mail address to the game partner(s) for the purpose of delivering the prize(s). Users are then explicitly informed of this and their prior consent is required.

For services offered by a third party (e.g. social networks), via a link available on the Sites, this third party is solely responsible for the management and collection of personal data that the User communicates to it on this occasion. Radio France neither collects nor retains the data provided on this occasion. The User thus acknowledges that these third-party services interacting with the Sites are totally independent of Radio France. Thus, access, consultation and use of these third-party services via the Sites will be exclusively subject to the conditions of use and/or sale as well as the personal data policies of said services. Users, consequently, adhere to the general terms of use of Meta platforms in particular, such as Messenger or WhatsApp.

If Users voluntarily disseminate personal data in Participatory Spaces, they are warned that it may be collected by a third party. Their subsequent use is in no way subject to the control of Radio France, which declines all responsibility in this respect.

9.5 Canvassing and sending Newsletters

Users are offered the opportunity to subscribe to newsletters relating to news and information from Radio France and its channels, events organized by Radio France and its channels for commercial or informational purposes, as well as partner offers, and to receive, where appropriate, offers concerning the services and events of Radio France, its channels and its partners. After registration, Users may unsubscribe at any time by clicking on the appropriate link in the newsletter e-mail. In this case, the User's data will be permanently deleted from the database of the newsletter in question, if he or she no longer has a subscription to any Radio France newsletters or a User Account.

9.6 Retention period for personal data

The information and data collected are kept in accordance with legal and regulatory obligations.

Personal data are kept by Radio France in accordance with simplified standard 48. In the particular case of the User Account, personal data is kept by Radio France for as long as the User Account is active. Once the User Account is deleted by the User or becomes inactive, i.e. without the User having authenticated for a period of two (2) years, the data is deleted by Radio France.

9.7 Rights of Users whose data is collected

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, as well as European Regulation no. 2016-679 on the protection of personal data, the User has the right to access, rectify, delete, oppose and port data concerning him or her, as well as the right to limit processing. To exercise these rights, the User should write to the following address: Radio France, Délégué à la protection des données personnelles, 116 avenue du président Kennedy, 75220 Paris Cedex 16 or an e-mail to the following address: dpdp@radiofrance.com, specifying the subject of his or her request and enclosing a copy of his or her identity document.

In accordance with the aforementioned provisions, the User may also define directives relating to the retention, deletion and communication of data concerning him or her after his or her death. To do so, the User must register such instructions with Radio France. To this end, the User may choose a person to be in charge of executing these directives or, failing this, his heirs. These directives may be modified at any time.

9.8 Security of personal data collected

Radio France ensures the security of data collected from Users through access control devices (management of the identities and authorizations of persons authorized to access personal data), making it possible to guarantee the confidentiality and integrity of said data.

Article 10: Liability
